1. Who we are
Vytal is a South African web design and development studio founded and run by Boikarabelo Tshabalala, working with a team. In these terms, "Vytal", "we", "us" and "our" mean Vytal. "You" means the person or business using this website or engaging us for work.

2. Using this website
By using getvytal.co.za you accept these terms. If you do not accept them, please do not use the site.
The content on this site is general information. We take reasonable care to keep it accurate, but it is not professional advice for your specific situation. You may not use the site unlawfully, attempt unauthorised access, disrupt it, or copy its design or writing for a competing service.
3. The free website audit
The free audit carries no obligation. By completing the form, you ask us to review the information you provide and send you a written professional opinion. You do not have to buy anything, and we do not have to accept a later project. We aim to send the audit within 2 to 3 working days, but this is a target rather than a guarantee.
4. Quotes, scope and how a project runs
A quote is valid for 30 days unless it says otherwise. A project starts when you accept the quote in writing and pay the first half. The agreed scope sets out what we will deliver. We agree and quote extra work before doing it.
Timelines are estimates made in good faith and depend on you supplying content, photographs, access and feedback when requested. A delay in receiving these items moves the delivery date.
5. Payment
For a website build, half is payable before work starts and the remaining half at launch, unless the written quote says otherwise. We may pause work when a payment is overdue. Care plans are billed in advance for each service period.
6. Ownership of the work
At launch and once the agreed project payment is complete, the website, domain and every login controlled by us for the project are handed over to you and owned by you. You may move the site or appoint another provider. Third party software, fonts, services and platforms remain subject to their own licences and terms. Content and brand material you supply remain yours.
7. Care plans, hosting and support
Care plans are billed in advance and cover only the services listed in the chosen plan or quote. You may cancel with one month's written notice. There is no cancellation fee. The plan ends after the paid notice period. New features, redesigns or work outside the plan are quoted separately.
8. What we need from you
You must provide accurate business information, content, photographs, access and feedback in a reasonable time. You confirm that you have the right to use everything you send us. You remain responsible for checking and approving final wording, prices, claims and legal notices before launch.
9. Cancellation and refunds
Your deposit is refundable at any time up to launch. You review the site on a private link before it is published. If, after that review and reasonable changes, we cannot get the site right, we refund what you have paid and publish nothing. If we end a project for a reason that is not your fault, we refund amounts paid for work not delivered. Nothing here removes rights that cannot lawfully be excluded under South African consumer law.
10. Finished, proposal and demo work
We may show finished work in our portfolio and on social media unless you ask us not to in writing. Work labelled "Proposal" is shown only to demonstrate the design presented. It does not mean the named business commissioned Vytal, approved the work, or became a client. Work labelled "Studio demo" is built for a fictional brand created by Vytal to show the standard of our work; no such business exists, nothing shown on it is for sale, and no client relationship is implied. Business names, trade marks and existing material remain the property of their owners.
11. Results and limits on liability
We work with reasonable care and skill, but do not guarantee rankings, traffic, enquiries, sales or any other commercial result. To the extent the law allows, we are not liable for indirect loss, lost profit, lost business or lost data. Our total liability for a claim is limited to the amount you paid us for the work giving rise to that claim during the 12 months before the claim. This does not exclude liability that cannot legally be excluded.
12. Third party services
Projects may rely on providers for hosting, domains, payments, email, analytics and other services. Their own terms apply. We are not responsible for their outages, fees, policy changes or decisions, but we will take reasonable steps to help resolve a problem affecting our work.
13. Changes to these terms
We may update these terms. The version in force when you accept a quote applies to that project unless we agree a change with you in writing. We will tell care plan clients about a material change before it takes effect.
14. South African law and disputes
These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction. If there is a problem, please raise it with us first at hello@getvytal.co.za so we have a fair opportunity to resolve it directly.
